Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the WisBot AI platform, website at https://wisbot.ai, and all related services (collectively, the "Platform"). By using the Platform, you agree to be bound by these Terms.

2. Definitions

  • "WisBot" or "we": Refers to WisBot AI, the company operating the Platform.
  • "Platform": The production platform for building, deploying, and monitoring AI agent applications, including templates, sandboxes, deployment pipelines, evaluation systems, and monitoring tools.
  • "User" or "you": Any individual or organization accessing or using the Platform.
  • "Project": A distinct agent application created, configured, and deployed through the Platform.
  • "End User": Any individual who interacts with an application deployed through the Platform by a User.

3. Eligibility

You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or the organization you represent. By using the Platform, you represent and warrant that you meet these requirements.

4. Account Responsibilities

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use. We are not liable for losses arising from unauthorized access to your account.

5. Platform Services

5.1 What We Provide

WisBot provides application templates, sandbox development environments, one-click deployment infrastructure, automated evaluation and quality gates, and production monitoring. You use these tools to build and ship AI agent applications to your clients.

5.2 Infrastructure Isolation

Each Project runs on dedicated, isolated infrastructure with its own database and runtime. We do not share resources or data across Projects or Users unless explicitly configured by you.

5.3 Availability

We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance and unforeseen outages may occur. We will make reasonable efforts to provide advance notice of planned downtime.

6. Your Content and Code

6.1 Ownership

You retain full ownership of all code, agent logic, configurations, templates, data, and infrastructure definitions you create on the Platform. WisBot does not claim any intellectual property rights over your content.

6.2 License to WisBot

You grant WisBot a limited, non-exclusive license to host, process, and transmit your content solely to operate the Platform and provide services to you. This license terminates when you remove your content or close your account.

6.3 Portability

You may export your code, configurations, and infrastructure definitions at any time. If you terminate your account, you may retrieve your content before closure. There are no export fees.

7. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose or to build applications that violate applicable laws or regulations.
  • Attempt to gain unauthorized access to other Users' Projects, infrastructure, or data.
  • Interfere with or disrupt the integrity or performance of the Platform.
  • Reverse engineer, decompile, or disassemble any part of the Platform's proprietary systems.
  • Use the Platform to infringe on the intellectual property rights of any third party.

8. End User Responsibility

You are solely responsible for the applications you deploy through the Platform, including their compliance with applicable laws, their accuracy, and their impact on End Users. You are responsible for maintaining your own privacy policies and terms of service for your deployed applications.

9. Payment and Billing

Paid plans are billed according to the pricing tier selected at the time of subscription. You authorize us to charge your payment method on a recurring basis. Failure to pay may result in suspension of access. Refund policies are governed by the specific terms of your subscription agreement.

10. Data Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Intellectual Property

The WisBot name, logo, platform interface, proprietary tooling, and documentation are the intellectual property of WisBot AI. These Terms do not grant you any rights to use our trademarks, branding, or proprietary systems beyond normal Platform use.

12. Disclaimer of Warranties

The Platform is provided "as is" and "as available." We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be error-free, secure, or continuously available.

13. Limitation of Liability

To the fullest extent permitted by law, WisBot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of or inability to use the Platform. Our total liability for any claim shall not exceed the amount you paid to WisBot in the twelve months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless WisBot, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform, your deployed applications, your violation of these Terms, or your infringement of any third-party rights.

15. Termination

Either party may terminate this agreement at any time. We reserve the right to suspend or terminate your access if you violate these Terms or engage in conduct that is harmful to other Users or the Platform. Upon termination, you may export your content as described in Section 6.3. We may retain certain data as required by law.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in California.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
